This statement covers WorldMark Holdings Pty Ltd ABN 68 087 705 262 and all its subsidiaries (such as the MotorOne Group, Martin Energy Products, High Performance Corporation, Customers For Life, Home One), which are collectively referred to in this statement as “WorldMark”, "we", "our" and “us”. A list of all the current WorldMark subsidiaries is set out in the WorldMark Privacy Policy.
This statement is a summary of key aspects of the WorldMark Privacy Policy. The statement generally informs you, in accordance with the National Privacy Principles, of who we are, and how and why we collect your personal information, as well as how we disclose and use it. It also tells you how you can access your personal information held by us, and obtain a copy of the WorldMark Privacy Policy.
We collect personal information when we provide our services to you. Generally, we will tell you why we are collecting information when we collect it and how we plan to use it, or these things will be obvious when we collect the information.
We usually collect personal information directly from you although sometimes we may use agents or service providers to do this for us. We may also acquire lists from other sources, both from other companies and public documents.
Any personal information obtained from you is used only for the purposes listed in this statement or in the WorldMark Privacy Policy, and is not disclosed to any other person except with your consent, or as permitted or required by law.
We usually collect personal information such as your name, address, telephone number and in some instances the details of a purchase which you have made from us. As a general rule we do not collect sensitive information about you. However, if we do, it will usually be for the purposes of providing our goods or services and, if the law requires us to, we will seek your consent to collect it.
We use your personal information to provide our services to you, to fulfil administrative functions associated with these services, for example billing, to enter into contracts with you or third parties and for marketing and client relationship purposes.
We may share your personal information with other companies which are related to us. We or they may also use your personally identifiable information to assist us in improving our products and services and any of us might be in touch to let you know about goods, services, or promotions which may interest you.
We may disclose your personal information to our service providers and contractors from time to time to help us to provide and market our goods and services to you. If we do this we generally require these parties to protect your information in the same way we do.

PRIVACY POLICY
Worldmark is the largest supplier of aftermarket products to Australian automotive dealers through a network of company owned and franchised operations. Worldmark also supply a state of the art range of window films for commercial and domestic uses and has developed a unique range of loyalty programs for automotive, real estate and personal care markets.
Products supplied include window tint, chemicals to protect vehicles paint, fabric and vinyl and chemicals to protect vehicles from damage caused from rust, automotive security and alarm systems and tinted window films specifically tailored for Australian conditions.
Brandnames include MotorOne, Tint A Car, Solace, Defense Pak, Ming, Ming Stealstopper, Laserline, Customers For Life and Waxguard.
WorldMark Pty Ltd and its associated companies (“WorldMark”) are committed to the principles embodied in the Privacy Amendment (Private Sector) Act 2000, which commenced in December 2001, and the Privacy provisions of all applicable legislation.

WorldMark is bound by the 10 National Privacy Principles.
This Privacy Policy covers all personal information held by WorldMark.
This Policy will be reviewed from time to time and any amendments will be incorporated in the updated Policy.
Personal information is information or an opinion, whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can be reasonably ascertained, from the information or opinion.
COLLECTION OF INFORMATION When we collect personal information from an individual, we will ensure that we do so in a fair manner and that we let the individual know where and how to contact our organization. We will only collect information that is necessary for one or more of our functions or activities.
Whenever we collect personal information from third parties concerning an individual, we will take reasonable steps to advise that individual as soon as is practicable.
We will advise individuals of the purposes for which their personal information is collected, and of those third parties to whom the information is usually disclosed.
If we collect sensitive information (as defined under the Act), we will treat it with the utmost security and confidentiality. We will ensure that it is not collected for any purposes, other than those for which we have obtained the individuals consent, unless the law requires otherwise, or other exceptional circumstances prevail as described under the Act.
Where an individual chooses not to provide requested information, we will advise that individual of what impact this non-disclosure may have. For example, withholding certain information may limit our ability to market relevant offers or perform certain services for those individuals.
How personal information is collected
The main ways WorldMark collects personal information include the following:
1. from information provided to business clients of WorldMark to automotive dealers and real estate agents (who then provide that information to us);
2. completion of an application form for a product or service;
3. the provision of information in face-to-face meetings or consultations.
4. information obtained from face to face meetings or consultations.
5. completion of warranty cards or proposals;
6. completion of an application for roadside assist programs;
7. completing an application for a loyalty program;
8. Commercial databases such as Oz on Disk;
9. main events staged at business clients of WorldMark;
10. our website;
11. via mail, email and telephone enquiries.
These are merely examples of some of the ways in which information will be collected and are not exclusive.
What personal information is collected? The personal information collected by WorldMark may include an individuals name, address, telephone number, driver's license, date of birth, occupation, sex, children’s names, email address, vehicle's vehicle identification number, vehicle color, vehicle features, make and model, place registered, registration date, registration number, engine size and transmission type, change of address and telephone information, date of purchase of vehicle, whether vehicle is financed or not, any other information voluntarily provided to us.
Why is the personal information collected? By collecting personal information, we are able to:
Provide advice regarding our range of products and services;
Attend to the administration associated with the provision of our wide range of products and services;
Improve upon our range of products and services;
Identify clients for the purpose of an ongoing business relationship.
USE AND DISCLOSURE OF PERSONAL INFORMATION All personal information collected by WorldMark is collected so that we may continue to operate our business by offering new and current products and services and for the administration of our warranty and loyalty programs.
Use of personal information
The main purposes that we may use personal information include the following:
1. Marketing via direct mail
2. Customer Loyalty programs
3. Roadside assistance programs
4. Provision of specific services to an individual;
5. Administration of Warranty Claims
6. Maintenance of Warranty contracts
Disclosure of personal information
We will only disclose personal information in accordance with the Privacy Act.
This means that personal information may be disclosed:
1. for the purposes for which we have advised that we are collecting it, and for related purposes that the individual would reasonably expect,
2. where we have the consent of the individual to do so,
3. as part of the asset sale of a business division, or WorldMark as a whole under a Deed of confidentiality;
4. as required by law,
5. or
under other circumstances where permitted under the Act.
In the course of our business activities, we may need to disclose some personal information to relevant business partners.
WorldMark will view unauthorised disclosure of, or access to, personal information by our employees, contractors or agents, as a serious breach of this Policy. Appropriate action (which may include disciplinary or legal action) will be taken in such cases.
When personal information is disclosed to any party outside WorldMark, where that party is contracted to WorldMark to provide administrative services or activities on our behalf, that party is bound by the same Privacy rules that WorldMark follow.
Direct Marketing
From time to time WorldMark forwards marketing materials directly to its customers and to customers of business clients on behalf of its business clients to provide information on offers for products and services offered by WorldMark.
We will provide an opt-out opportunity with direct marketing offers in accordance with the legislation and will never charge individuals for contacting us to register a request to "opt-out" from receiving further marketing offers.
If an individual chooses not to receive any marketing materials from WorldMark, they may miss out on special product and service offerings and opportunities.
WorldMark does not and will not disclose personal information to any third party for the express purpose of allowing them to direct market their products or services, unless we have consent to do so.
From time to time, we may be required by law to provide certain information about our products or services including product recalls. In these instances, individuals will continue to receive such information, even if they have elected not to receive any information about our products and services generally.
Roadside assistance program
WorldMark engages contractors to provide a Roadside Assist. Service. WorldMark’s agreement with these contractors requires WorldMark to deal with personal information in accordance with the Privacy Act.
If an individual withdraws their consent to WorldMark disclosing their personal information to these contractors, this will affect WorldMark’s ability to deliver these services.
Loyalty Programs
Worldmark operates a customer contact and loyalty facility on behalf of client businesses for the provision of value added benefits to their existing customers plus the dissemination of information on additional services, products, topics of interest and special offers that may become available from time to time. Client businesses are required to conform and comply with relevant legislation relating to use of information received and held about their respective customers.
Warranty programs
As part of the purchase of many of our products, a warranty is issued to the customer. WorldMark collects personal information from the customer so that the warranty claim is properly administered.
If an individual withdraws their consent to WorldMark collecting their personal information for this purpose, this will affect WorldMark’s ability to process warranty claims.
Sensitive information
Sensitive information is a particular kind of information that requires even greater care.
By way of summary, sensitive information can be information about political opinion, racial or ethnic origin, membership of a political association, religious beliefs or affiliations, philosophical beliefs, membership of a professional or a trade association, membership of a trade union, sexual preferences or practices, criminal record or health.
WorldMark will only use or disclose sensitive information where we have received express consent to do so, it is provided for by law or where it is necessary for the establishment, exercise or defence of a legal claim against us.
DATA SECURITY AND INTEGRITY
Protection of personal information and ensuring that it is accurate, up to date and complete is a priority for WorldMark.
Access to personal information
Individuals will be able to access their personal information upon request. However, WorldMark may occasionally need to deny access to information in accordance with the exemptions contained in the Act.
Generally, a summary of the personal information held by us will include an individuals name, address details, contact telephone number and the products and services purchased from us.
With more detailed requests for access to personal information, WorldMark reserves its right to charge a fee in order to cover the cost of the retrieval and supply of the information.
All requests for access to any personal information will be handled as quickly as reasonably possible and should be processed within thirty (30) days of receipt of the request. Occasionally, some requests for access may require longer than the thirty (30) day period, and this will depend upon the nature of the personal information being sought.
From time to time, WorldMark may be required by law to retain all or some personal information for a period of time after the relationship has ceased. After the nominated time has passed, WorldMark will either securely destroy the documentation or delete it from our records.
WorldMark will not always be required by operation of the new Privacy legislation to provide access to personal information.
Access may be refused in a number of circumstances. These include:
1. Where the information may relate to existing or anticipated legal proceedings;
2. Where denying access is required or authorised by law;
3. Where the request is regarded as frivolous or vexatious.
However, where we deny access or refuse to correct personal information, we will explain why.
Security of personal information
Our goal is to protect the personal information collected by WorldMark. Personal information will be managed confidentially and securely and destroyed appropriately when no longer required.
We will monitor and implement appropriate technical advances or management processes to safeguard personal information.
WorldMark will take all reasonable precautions to safeguard such personal information from loss, misuse, unauthorised access, modification or disclosure. To protect personal information, WorldMark will utilise techniques which may include, but will not be limited to the following:
1.
Where appropriate, entering into confidentiality agreements with contractors and training personnel and familiarising them with the new legislative obligations and our Privacy policies and procedures;
2. Train and have employees sign a declaration that they have been provided with a copy of WorldMark’s Privacy Policy and that they understand its requirements and undertake to abide by it;
3. Where appropriate, having stand-by systems and auxiliary systems to deal with anticipated and unanticipated major business interruptions;
4. External and internal premises security;
5. Restricted access to personal information;
6. Continued upgrading and overview of our information technology practices to prevent unauthorised computer access;
7. Further review and testing of technology employed by WorldMark in terms of the provision of security;
8. Confidentiality agreements with potential buyers of parts or all of WorldMark.
Wherever lawful and practical to do so, we will provide individuals the opportunity to deal with us anonymously.
Data integrity
WorldMark will take all reasonable steps to ensure that the data WorldMark collect, use or disclose is accurate, complete and up to date, and has been obtained directly from individuals or other reputable sources.
To this end, WorldMark will ensure that marketing communication campaigns are regularly checked against the ‘opt-out’ register.
WorldMark relies on the accuracy of personal information as provided to it directly or indirectly. WorldMark encourage individuals to make direct contact if the personal information we hold about them is incorrect.
When WorldMark no longer use information WorldMark will take care to properly de-identify or destroy it.
Storage of personal information
WorldMark stores personal information in transmission logs and archives for a period WorldMark considers reasonable depending on the primary purpose for which that information was collected. Only personnel who have a need to access personal information to perform their job will have access to that information. The physical and electronic security systems at WorldMark comply with the recommendations of the Federal Privacy Commissioner.
Personal information will be de-identified or destroyed when it is no longer required. The de-identification and destruction process will be in accordance with the recommendations of the Federal Privacy Commissioner and will ensure that the personal information cannot be re-identified at a later date.
Training
WorldMark will ensure that its employees receive training (and refresher training) about the management of personal information relevant to their respective roles and responsibilities. Only properly authorized people are permitted to see or use personal information held by WorldMark.

Collection of Information
When entering any of WorldMark's websites, WorldMark’s Internet service provider logs the following information for statistical purposes:
1.The individuals server address
2. the top-level domain name (e.g. .com, .org, .net, .au, etc.)
3. the date and time of visit
4. the type of browser being used
5. the previous site visited
6. the pages accessed and the documents downloaded
WorldMark does not provide facilities for the safe transmission of information across the Internet. Individuals should be aware that there are inherent risks in transmitting information across the Internet.
Individuals can visit WorldMark's websites as a guest while remaining anonymous by not providing any personal information. Although, without this information, they may not be able to fully access all of the features and functionality of the site. However, WorldMark servers automatically collect some limited information about each visit that is not personally identifiable.
WorldMark sometimes uses "cookies" to track and record an individuals preferences and activity on our website. Cookies are small bits of data that are sent to the individual’s browser and stored on their computer's hard drive. A cookie may be set at various times during each interaction with our website. It is updated from time to time as the many different portions of our website are accessed. Each time an individual accesses our site, our server may deliver certain customized information to that individual based on the data stored in your cookie.

Use of information
WorldMark's primary goal in collecting personal information is to provide the user, with a customized experience on our website.
WorldMark’s web site uses various forms for gathering information when applicable. Registration, survey and order forms all, to some extent, require input of personal information. These forms require users to give WorldMark contact information (like name and email address), demographic information (like post code, age, or income level), and other applicable information. This information is used to contact the visitor when necessary, to send out information about WorldMark or its products or websites that may be of interest, and to respond to queries.
WorldMark may also use the information to estimate the size of the audience and measure certain traffic patterns, to track the progress and number of entries in promotions and contests, to track visits to linked sites, to notify visitors about updates to the website, and to contact individuals for marketing purposes and provide information regarding special events sponsored by WorldMark.
